A refusal to use the right of pre-emption of local governments, if real estate is seized in the administrative territory of local governments and it is not necessary in order to fulfil the functions of local governments specified in the Law:
- adoption of documents for deciding the matter on the right of pre-emption of the local government;
- the issue of a statement regarding the acceptance of a contract for the purchase of immovable property or a true copy thereof;
- adoption of a decision on the exercise of the right of pre-emption or refusal to exercise the right of pre-emption;
- issuing a statement of refusal to exercise the right of pre-emption.

Process description

  1. Service requests
    Receipt of services documents required:
    1) the seller or buyer must submit an application for the consideration of the right of pre-emption (in a free form or using the proposed model) to which the purchase contract is attached;
    2) if the application is submitted by an authorised person, the power (original) to represent the seller or buyer in the sale of real estate and/or in the performance of the related activities shall be presented.

    Seller or buyer:
    - the application may be submitted in person at the Customer Service Centre of the Riga City Council Property Department;
    - an application signed with a secure electronic signature may be sent to the e-mail address of the property alienation board of the Riga City Council;
    - the application may be sent by post to the Bureau of Property Depropriation of the Riga City Council.

    Document to be submitted: Application for consideration of the right of pre-emption

    In matters, in relation to the receipt of the service, to turn to the Riga City Council Bureau of Property Defeiture, by phone - 67026241; 67026320.

  2. Receipt of services
    Upon receipt of the purchase contract, a statement regarding the acceptance of the real estate purchase contract shall be issued in the local government;
    Within 5 working days of the adoption of the purchase contract in the local government, a statement regarding the refusal to exercise the right of pre-emption;
    Within 20 days after the adoption of the purchase contract in the municipality - a decision of the Riga City Council regarding the exercise of the right of pre-emption or a refusal to exercise the right of pre-emption;
    Within 2 months of the adoption of the purchase contract in the municipality - a decision of the Riga City Council regarding the exercise of the right of pre-emption or a statement regarding the refusal to exercise the right of pre-emption.

    The service execution documents shall be received in person, the e-mail address of the person indicated in the application, signed with a secure electronic signature, or by post, as well as shall be placed in the State Uniform computerised Land Register, using an online solution specifically provided for it.
